1. Short title

This Act may be cited as the "No Data Center NDAs Act".

2. Prohibition with respect to certain nondisclosure agreements related to data centers

(a) In general - A Member of Congress may not sign any nondisclosure agreement with any unit of State or local government or any private entity as a condition on receiving access to information with respect to the planning or development of a data center, including information with respect to planned or received investments, location planning, construction designs, or water or energy resource consumption.

(b) Restriction on use of Federal funds - No funds appropriated or otherwise made available from the U.S. Treasury may be used to implement or enforce a nondisclosure agreement described in subsection (a).

(c) Regulations - The Committee on Ethics of the House of Representatives and the Select Committee on Ethics of the Senate shall each promulgate such regulations as may be necessary and appropriate to carry out the prohibition under this section.

(d) Definitions - In this section:

(1) Data center - The term "data center" has the meaning given such term in section 453(a) of the Energy Independence and Security Act of 2007 (42 U.S.C. 17112(a)).

(2) Member of Congress - The term "Member of Congress" means a Senator or Representative in, or Delegate or Resident Commissioner to, the Congress.
